Job Requirements for Court Process Servers

• Diploma (in Legal Studies) from an accredited institution.
• KCSE (Kenya Certificate of Secondary Education) mean grade C (At least)- mean grade C- needed in English/Kiswahili and Geography.
• Proficiency in computer/ICT applications
• You must be registered as a court process server in Kenya.
• Hold a current court process server license

Required Behavioral Skills

In addition, you need the following behavioral attributes:

• Good communication skills
• Great interpersonal skills
• High levels of Integrity
• Positive attitude
• Honesty and transparency

Besides, you must have a good understanding of civil procedures and rules thereunder regarding the service of court processes (check Civil Procedure Act, especially Order 5).

In addition, you might be required to have at least 3 years’ experience in positions such as a clerk/legal assistant (in a registered law firm)- and you must provide a recommendation letter (vouching for your working experience)from a referee.

Needless to say, you must be an adult (above 18 years).

What do Court Process Servers do?

For starters, a court process server is expected to do the following:

1. Serve court process (in accordance with the provisions of Kenyan law)
2. File affidavit(s) of service
3. Maintain a register/record of the service of court processes
4. Perform assigned clerical duties
5. Man the legal department registry/documents
6. Perform any other/further duties (as allocated from time-to-time)

Besides the above qualifications, you will need to write and pass the Proficiency Examination (for local Court Process Servers & Court Bailiffs).

The exam is organized by the JSC (Judicial Service Commission) and you must have passed it to be licensed – Process Servers are essentially licensed by Kenya’s judiciary through the Judiciary Court Process Servers Committee.

The other key partner in the licensing process is the CPSSK(Court Process Servers Society of Kenya).

The body -registered under Kenya’s Society Act- represents/fights for the welfare of licensed Court Process Servers in Kenya.

It also pushes for reforms that will lift the status of this important cadre of court officials.

In fact, the society has drafted the Court Process Servers Act as a first step in addressing matters such as discipline and minimum qualifications to be hired.

How to get a process server certificate in Kenya

You start by attending the interviews. These interviews are typically advertised from time to time by the Judiciary Court Process Servers Committee.

Remember that exams are written by those who pass the interview.

Unfortunately, there is not much information at the moment about the entire application for licensing process but you can try your luck by dropping your application for the court process server position at the Milimani law courts- ground flr, Rm 15.

Where to find court process server jobs in Kenya

Court process servers can work in a law firm- your role here  is to help advocates serve orders, pleadings, and other legal documents.

You can also be hired by:

• Individuals
• Private companies
• Corporates
• The Government (Agencies and Departments such as IPOA hire court process servers from time to time in Kenya).

That said, many work as freelancers- they serve official court documents on behalf of law firms, financial institutions, and other organizations at an agreed fee.

Court process server salary in Kenya

You can earn Ksh1,000 (at least) if you’re serving court papers within a 10-kilometres radius (of a court).

You definitely earn more if you will be venturing further.

I should mention that court process servers often negotiate a higher fee if serving in risky places– the extra amount is intended to cover the involved risk.

This is particularly necessary if you need police escort for protection when serving.
